Court Throws Out Sam Smith “Stay With Me” Lawsuit

The lawsuit against Sam Smith over his hit, “Stay With Me,” is being thrown out.  Songwriter Mark Halper filed suit against the singer in 2015 for allegedly stealing the lyric, “stay with me,” from his song, “Don’t Throw Our Love Away.”  The suit asks for acknowledgment for the lyric from the National Academy of Recording Arts and Sciences, which awarded Smith’s song with a Grammy.  A judge closed the case because of lack of proof that Smith had access to Halper’s song, and because the lyric is not protected under copyright law.
